1. Acceptance of Terms
By accessing or using GetTranscribe ("Service"), operated by ACHIEVE APEX LLC (Delaware, United States), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not access or use the Service.
2. Description of Service
GetTranscribe provides AI-powered transcription services for videos from platforms including but not limited to YouTube, Instagram, TikTok, and Facebook. The Service processes video content to generate text transcriptions and related analysis features.
3. User Registration
You may be required to register for an account to access certain features of the Service. You agree to provide accurate information and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Process videos containing illegal, harmful, or offensive content
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
5. Content Rights and Permissions
You are solely responsible for ensuring you have the right to access and process the videos you submit to our Service. By using our Service, you confirm that you have the legal right to process the videos and generate transcriptions from them.
6. Billing, Subscriptions, and Refunds
Paid plans may be purchased on the web through Stripe or through the Apple App Store on iOS. Prices, plan limits, and fair-use allowances are described on our pricing page and may change over time. Subscriptions renew until you cancel.
Web subscriptions can be managed or canceled from your GetTranscribe account. Apple App Store subscriptions must be managed or canceled in your Apple ID / App Store settings. Refunds for web purchases may be requested from your account within 3 days of purchase or before completing 3 transcription processes, whichever comes first. App Store refunds are handled by Apple under Apple's refund policies.
7. Intellectual Property
GetTranscribe and its original content, features, and functionality are owned by ACHIEVE APEX LLC and are protected by international copyright, trademark, and other intellectual property laws. The transcriptions generated by the Service are provided for your use, but the technology and systems that power the Service remain our property.
8. Limitation of Liability
To the maximum extent permitted by law, ACHIEVE APEX LLC and GetTranscribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service, including but not limited to loss of profits, data, use, or other intangible losses.
9. Service Modifications
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of these terms and/or by notifying you via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
